These terms of use (this "Agreement") set forth the standards of use of www.competencymatters.com located at http://www.competencymatters.com. The www.competencymatters.com and all such associated pages and websites are collectively referred to herein as the "Website."

The terms and condition document refers Competency Matters as “we’, “us” or “our” and any visitor to the website or registered learner (s) as “you”. Please read this document very carefully. This electronic version of terms and conditions shall be effective and binding upon you as a registered learner or visitor of the site. If you do not want to accept these Terms, you must not use or are not authorized to use any or all part of the website and products or services offered through the website.

Amendments

Competency Matters may amend or update this terms and conditions at any time by uploading any changed or revised version on the website. You agree to be bound to any changes to this terms and conditions when you use our services immediately after any such amended version is posted. You are advised to regularly check for any amendments or updates to the terms and conditions contained in this agreement and policies.

Governing Laws

This document is an electronic record in terms of Indian Information Technology Act, 2000 and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. Laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Kolkata, India.

Services Offered

Competency Matters provides educational services to registered learners through its website www.competencymatters.com (website) against successful submission of filled up registration form payment of stipulated fees. Registered learners of Competency Matters receive the study material in electronic formats to their registered mail box for which they have made the payment of fees successfully. Schedule of course commencement, interactive sessions, and examinations shall be announced in the website.  Registered learners are entitled to participate in online interactive learning session, Chat Box, Blogs, Article Section and online examination as per terms of the course as detailed in course overview. Registered learners who have successfully paid the registration fees can also opt for career assistance service from Competency Matters by mailing Curriculum Vitae (Bio Data) and requirements for assistance required.

Registration : Successfully registered learners will be allowed to participate to a scheduled course or collection of scheduled courses by payment of fees as applicable on the information page of the particular course. Please note that discounts, if applicable on any course is valid within effective dates.

Competency Matters retains the rights to modify the Registration Service from time to time, including provision of time limit, adding or deleting features and functions. But Competency Matters will restrain efforts to make any change to the service that alters or reduces the functionality of the Registration Service provided to you during Registration. We might provide some or all elements of the Registration Service through third party service providers.

The Registration Service is provided “as is” and without warranty of any kind. We may suspend, limit, or terminate the Registration Service for any reason at any time without notice, and we will not be liable to you for damages of any kind related to your use of the Registration Service.

Credit cards and other payment methods accepted by the payment gateways can be used by learners for payment of fees for Registration. Once the Registration Services are accepted the learner authorizes Competency Matters and any of its affiliates to debit the accounts as may be notified to the registered learner.

Your Registration Services will remain in effect for three sixty days from the date of payment of fees for a course. If you cancel your Registration Services, you will have to register afresh.  The discount if applied at the time of registration may not be the same discount in effect at the time of cancellation. If you register afresh the new discount if applied will be applicable to your course.

All fees are exclusive of taxes, as applicable. You agree to pay any taxes applicable to your use of the Registration Service. All fees are exclusive of any VAT, Service tax, GST or any other applicable law and tax deductions. If you are required to deduct or withhold any tax, you must pay the amount deducted or withheld as required by law and pay us an additional amount so that we receive payment in full as if there were no deduction or withholding.

Your obligation on Registration

You should not use this site in an unlawful manner; you must respect the website terms and conditions and follow the Privacy Policy.

Under no situations or circumstances, we will be liable for any change in the content provided on the website through courses and services, including but not limited to any errors, omissions, loss, or damage experienced in connection with the use or exposure via our courses, services, such as email, blog, chat room, Articles, references, career assistance etc. You will be required to use login credentials for some of the sections on the site.

We are not responsible for the charges incurred for the usage of hardware, software, or internet services provider fee. Also, the user is fully responsible for the proper functioning of computer hardware and internet access.

We make sure that users get uninterrupted access to our service, but there is no obligation to do so.

Competency Matters is not responsible and is not obligated for issues in your network or server.

Website usage guidelines

Do not publish post, distribute or disseminate any defamatory, infringing, indecent, offensive or unlawful material or information.

Do not insult, abuse, harass, stalk, threaten, or otherwise infringe the rights of others.

Do not upload, install, transfer files which are protected by Intellectual Property Laws or software which affect other computers.

It's prohibited to edit HTML source code, reverse engineer or attempt to hack.

Do not run Spam services/scripts or anything which could affect the infrastructure, and in turn, the users.

Do not communicate spam, advertise, or sell services such as digital downloads, eBooks, or phishing links.

You may not copy, distribute, and indulge in plagiarism with website content or user submitted content.

Do not use any content which violates any legal, regulatory, Governmental or network operator conditions or codes of practice.

Competency Matters reserves the right, in its sole discretion, to reject, refuse to post or remove any posting  by you, or to restrict, suspend, or terminate your access to all or any part of the Competency Matters website and Services at any time, for any or no reason, with or without prior notice, and without liability.

Eligibility

Our website is for learners above fourteen year of age. Use of and registration in the Competency Matters Services is void where prohibited by law. By using the Competency Matters Services, you represent and warrant that (a) all registration information you submit is truthful, full (no abbreviations), and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the Competency Matters Services does not violate any applicable law or regulation.

Terms

This Agreement shall remain in full force and effect while you use the Competency Matters Services or are a Registered Learner. You may terminate your Registration at any time, for any reason, by following the instructions on the Registered Learner's Account Settings page. Competency Matters may terminate your Registration at any time, without warning. Even after Registration is terminated, this Agreement will remain in effect.

User ID and Password

Cinaccurate, not current or incomplete, or not in accordance with the User Agreement, Competency Matters has the right to indefinitely suspend or terminate or block access to the Websitonfidentiality of your password. You agree not to use the account, username, or password of another Registered Learner at any time or to disclose your password to any third party. You agree to notify us immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account. You will always maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or Competency Matters has reasonable grounds to suspect that You are responsible for maintaining the confidentiality of your User ID and Password as a registered learner. As a Registered Learner, you will be asked to choose a password. You are entirely responsible for maintaining the such information is untrue, e and refuse to provide you service.

Non-commercial use by registered Learners

The Competency Matters Services are for personal use of Registered Learners only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Competency Matters. Illegal and/or unauthorized use of the Competency Matters Services, including collecting usernames and/or e-mail addresses of Registered Learners by electronic or other means for the purpose of sending unsolicited e-mail or unauthorized framing of or linking to the Competency Matters Website is prohibited. Commercial advertisements, affiliated links, and other forms of solicitation may be removed from Registered Learner profiles without notice and may result in termination of Registered Learner privileges. Appropriate legal action will be taken for any illegal or unauthorized use of the Competency Matters Services.

Electronic Communication

When you register with Competency Matters as a learner you consent to receive communications via electronic records from Competency Matters periodically and as and when felt required by us. Competency Matters will communicate with you by email or autodialed or prerecorded calls and text messages at any telephone number that you have provided us or that we have otherwise obtained or by an electronic records on the Website which will be deemed adequate service of notice / electronic record.

Proprietary Rights

Competency Matters owns and retains proprietary rights in the content and service provided through website. You may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display or sell any content appearing on the website or provided through the Competency Matters services.

Content Posted

Competency matters may delete any communication or content that, in the sole judgment of Competency Matters, (a) violates this agreement (b) may be offensive or illegal or (c) harms, threatens the safety of, or violates the rights of any person. Competency Matters assumes no responsibility for monitoring services provided for inappropriate communication, content or conduct. If any time Competency Matters chooses, in its sole discretion, to monitor its services, Competency Matters nonetheless assumes no responsibility for any communication or content. Competency Matters has no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of any user of the website submitting such content.

  Links and Hyperlinks

The Website may contain links to other websites ("Linked Sites"). The inclusion of any link does not imply endorsement by Competency Matters or the Website of the Linked Sites or any association with its operators or owners including the legal heirs or assigns thereof. Competency Matters is not responsible for any form of transmission, whatsoever, received by you from any Linked Site. Learners are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

We are not responsible for the conduct, whether online or offline, of any User of our Services. Competency Matters assumes no responsibility for any error, omission, interruption, deletion, defect, delay, change in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User or Registered Learner communication. Competency Matters is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or players due to technical problems or traffic congestion on the Internet or on any Service or combination thereof, including any injury or daCompetency Matters is not responsible for any incorrect or inaccurate information or content posted on the Website or used in connection with the Services provided, whether caused by other Users of the website Services or by any of the equipment or programming associated with or utilized by Competency Matters. We do not guarantee the efficacy of its learning content & material. Other provisions may be added to qualify our liability to the presentation of effective quality education and training material. Profiles created and posted by Registered Learners on the Website may contain links to other websites. We are not responsible for the Content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked website to our Services does not imply approval or endorsement of the linked website by us. When you access these third-party sites, you do so at your own risk. Competency Matters takes no responsibility for third party advertisements which are posted on the Website or mage to Users or to any person's computer related to or resulting from participation or downloading materials in connection of our services. We cannot guarantee and do not promise any specific results from use of our Services.

Limitation of Liability

Competency Matters shall not be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit arising from your use of the website and services, even if Competency Matters has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, liability of Competency Matters to you for any cause whatsoever and regardless of the form of the action, will be at all times limited to the amount paid, if any, by you for the service terms during registration as a learner.

We don’t authorize any third party except our payment gateway partner to accept payments on behalf of Competency Matters for any Service. We are not liable for any payments made to a third party by Registered Learner.

Competency Matters cannot provide a refund or exchange for a PDF (Portable Document Format) certificate.

 

Indemnity

You agree to indemnify and hold Competency Matters, its  staff, agents, partners and employees, harmless from any loss, liability, claim, or demand, including attorneys' fees made by any third party due to or arising out of your use of our Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth and/or if any Content that you post on the Website or through Services causes Competency Matters to be liable to another.

Pricing Disclaimer

Competency Matters reserves the right to change the amount of registration fees of its courses and services. These changes may be required for wrong display, advertisement, error, market condition, etc. However the fees paid by you for registration to a course(s) remains unchanged.
